Recently San Diego City Council and the Public Safety Comitee has formed a Medical Marijuana Task Force to "hopefully" establish better Guidelines including proper Zoning for Medical Marijuana Cooperatives in our city. In addition LOCAL authorities and politicians have been in a struggle to clearly define what is legal under Prop 215, Senate Bill 420 and the Attorney Generals Guidelines issued in August of 2008. We have strived to do the right thing for our local community and have placed limits and rules upon our Cooperative members to ensure our compliance with all laws. We are respected by our local business' , neighboors and community and only wish to be of assistance, and NEVER a burden on our community.
As of October 15 we will closed temporarily as a proactive measure to ensure the safety of our members and the long term survival of our cooperative. It is our hope during this time our Local Government can establish a better understanding of the Medical Marijuana laws or establish additional Guidelines or regulations. We are not closing permanently, and will re-open as soon as these very important issues can be properly understood. We apoligize to all of our Members and look forward to coming back when our City can decide upon these very important issues. The Soul Provider is a NON- Profit Cooperative organized for the safe access of our medicine and greater good of our community.
Our Private Membership is open to California residents age 21 and over diagnosed with a serious medical condition and that the medical use of cannabis is recommended for that serious medical condition. Our Active members must have a valid Medical Marijuana Reccomendation by a Licensed California M.D. or D.O.We offer a safe place for OUR members to cooperatively cultivate and distribute marijuana for medical purposes , while also organized and operated in a manner that ensures the security of the crop and safeguards against diversion for non-medical purposes. Most importantly we are not a "collective" or "dispensery." We are a Co-op and No business may call itself a "Cooperative"(or "co-op") unless it is properly organized and registered as such a corporation under the corporations or food and agricultural code.(Id. at § 12311(b).) Cooperative corporations are “democratically controlled and are not organized to make a profit for themselves, as such, or for their members, as such, but primarily for their members as patrons.” (Id. at § 12201.) The earnings and savings of the business must be used for the general welfare of its members or equitably distributed to members in the form of cash, property, credits, or services. (Ibid.) Cooperatives must follow strict rules on organization, articles, elections, and distribution of earnings, and must report individual transactions from individual members each year. (See id. at § 12200,et seq.) Agricultural cooperatives are likewise nonprofit corporate entities “since they are not organized to make profit for themselves, as such, or for their members, as such, but only for their members as producers.” (Food & Agric. Code, § 54033.) Agricultural cooperatives share many characteristics with consumer cooperatives. (See, e.g., id. at § 54002, et seq.) Cooperatives should not purchase marijuana from, or sell to, non-members; instead, they should only provide a means for facilitating or coordinating transactions between members.
