There's a very disturbing trend I'm seeing in the aftermath of the raids; people lapping up news reports and, in the process of trying to make sense of all of this, they're making some pretty big mistakes.
There aren't 8 LEGITIMATE COLLECTIVES. Any more discussion of that will get deleted, that was an incorrect factoid that floated around some newspapers but the fact is both Bonnie and the police chief have stated there are NO LEGITIMATE COLLECTIVES.
Don't accept hook, line, and sinker what Bonnie says. Yes, we can all I'm sure pick some shady collectives out of the ones that got raided, but the fact is they were all running pretty much the same way as all of the collectives. While you all sit and argue about how places are shady, you're missing the point. This is in no way a helpful "rooting out of the bad apples".

Now, this is the most important part, something that everyone needs to understand: Legally, the police are saying that every collective needs to grow their own medicine. This is literally PHYSICALLY IMPOSSIBLE because of the way the limits on growing and possession are designed. There is no collective that runs this way. Not to mention they believe it's illegal to be able to walk off the street with your recommendation and get meds.
Before we all start eating out of Bonnie's hand and turning against each other, we need to realize that she is saying everything we do is entirely illegal, and the raids will continue.

Can anyone confirm which co-operatives, if any, received Cease & Desist orders? Does anyoe know how many of the SD dispensary arrests last week will proceed to an actual court case? I can't imagine the city/county spending significant resources on prosecuting perhaps a majority of these cases. If and when these cases go to court, I suspect the DA will have to define for the court exactly what criteria cooperatives must abide by to be legal. At present, she is hiding behind ambiguity that will soon fall apart.

Cease and Desist or Organize and Resist?

Yesterday, police visited local dispensaries and told them to close or else they would receive cease and desist letters from the DA's office.

San Diego's DA has said that collectives are operating illegally because they’re making a profit. But it’s not illegal for a non-profit organization to make a profit. Both for-profit and non-profit organizations must generate a profit in order to survive and grow.

Some non-profit organizations make huge profits. Top CEO’s at non-profit hospitals and charities routinely earn multi-million dollar salaries. And when was the last time you saw one of them being taken away in handcuffs?

The difference between a for-profit and a non-profit organization, isn't the amount of money they make, but what's done with the profits. After all salaries and benefits, operating costs, fees and taxes, etc. are paid, whatever money is left over has to go back into growing and improving a non-profit organization. Net profits from a for-profit company, on the other hand, belong to the owners and shareholders, if any, to do with as they wish.

Most of the collectives now operating in San Diego County have yet to file their first income tax return. So, there’s really no way for city officials to know what their net profits for 2009 will be. Or, to know how they intend to use those profits to grow and improve their organizations.

It seems to me, that San Diego collectives should organize and pool their resources, then find a publicity-seeking shark of an attorney to represent them in a class action suit against the city, for violating their right to exist and make money. Let a court of law – not the DA’s very biased opinion – decide your rights!

I recently received this report from an anonymous legal Medical Cannabis Patient/ Co-Op member regarding the continued harassment by Law Enforcement: in San Diego:

A narcotics officer came in last night and demanded the administrators personal information. he would not leave until we gave it to him. he said he was getting all admins personal info for records and that the "task force" was going to be sending letters, that's why he needed it. I know he went to Mother Nurture and a couple others in SD. I feel it is a ploy to get their personal info so they can raid their houses along with their businesses. If you could post this all over for me, it would help others.

I fear the author of this report's suspicions may be correct. Please, PLEASE - Take care of yourselves and each other. Those of us that are desperately reliant upon this medicine in order to live just a bit healthier, to ease the serious pain that the strongest pharmaceuticals can not help, we Medical Cannabis Patients can not afford to lose our rights.

i just got an email from san diego herbal alternatives in regards to the "cease and desist" notices. anyone know whether this is a scare tactic or if theyre really going through with it?

heres their email:
Dear Patients,

We regret to inform you that the attacks on medical marijuana in San Diego are not over. We were just visiting by the San Diego Police Department and were told that we will be receiving a cease and desist letter in the mail.

These notices are being given to all dispensaries in San Diego. Once we receive the letter we will likely be forced to shut down. We wont receive the letter until at least tomorrow so we will be open for the remainder of today until 8pm. We will send out a follow-up announcement letting you know if we will be open tomorrow.

If you have a couple minutes to help stop these attacks on medical marijuana dispensaries and patients please take the following actions:

one thing for everyone to remember....there are essentially three groups of people who dont want marijuana to be legal:

1:the san diego DA/police forces - this one is obvious,from their behaviour
2:the misinformed - people who still think that marijuana is an evil hardcore drug,as bad as crack,that will hunt down and kill their kids

and,the last one,that most people seem to overlook
3:illegal pot dealers - legalization will kill their business,pure and simple...in fact,they probably want it to stay illegal more than the other two groups combined....it is their livelyhood,it is their income,and they are,for the most part,criminally minded...these are the people we worked to get away from,by becoming legal patients instead of illegal self treating patients...we need to repeatedly remind the other 2 groups on this list that these people,the illegal street dealers,who deal not only pot,but crack,heroin,coke,meth,lsd,ketamine,extacy,and other drugs,including schedule 2 drugs obtained illegally and sold illegally,are their currect moral bedfellows

by smashing the legal use of pot for medical reasons,and refusing to legalize it for recreation,these people are insuring that the illegal back alley drug dealers continue to have swollen pocketbooks,from selling pot illegally....in short,bonnie dumanis supports drug dealers by being against medical marijuana dispensaries

Craig Beresh of S.Cal NORML reports that at least 14 San Diego
dispensaries received "cease and desist" visits by the S.D. police
yesterday. They were told that a written notice would follow
shortly. Numerous other dispensaries remain closed in the wake of
the recent raids. As the following report indicates, police are
falsely spreading the notion that collectives can't operate legally
under state law. S. Cal NORML is contemplating legal action against
San Diego.

As I am not for trouble, I'll say I agree with you, but this is getting to be ridiculous, who CARES where I smoke? People walk around drink, walk around pop pills, walk around shoving food through their rich fat mouths, but I can't walk and smoke my blunt? It says it is LEGAL for me to possess and use marijuana, simple, does it say DO NOT take your zoloft in the park? Does it say, DO NOT smoke your cigarettes outside? Don't alcohol users take lightly the law of open containers off of the property? They sure do. Considering alcohol is far worse and more dangerous for you, I believe if there's a bar to get drunk, there should be a bar to get high, and I SWEAR TO YOU, If you can purchase alcohol at DISNEYLAND, THEN YOU SHOULD BE ABLE TO PURCHASE CANNABIS AT DISNEYLAND, NOT ONLY WILL IT MAKE YOUR EXPERIENCE A LOT MORE FUN, YOU WON'T PUKE ON AN EMPTY STOMACH! PREACH!
